Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Timeburg, a FiveToClose product ("Timeburg", "we", "us"). By signing in to or playing Timeburg at timeburg.com (the "Service"), you agree to these Terms, our Rules, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

• You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these Terms for you and approve any purchase.
• You sign in with Google. You are responsible for your Google account and for everything that happens on your Timeburg account.
• Give us accurate information and keep one account per person.

3. Free to play

The Service is free to play. Purchases are optional and are never required to play the game.

4. Virtual items and credits

• You can buy credits, passes, packs and other virtual items ("Virtual Items"). When you buy or earn Virtual Items, we give you a limited, personal, non-transferable, non-sublicensable, revocable license to use them inside the Service. You do not own them.
• Virtual Items have no cash or real-world value. They cannot be redeemed for money, sold, traded, gifted or transferred, except where the Service offers that feature.
• We may change, rebalance or discontinue Virtual Items and their prices. We may limit how many you can buy or hold.
• A pass (for example the Mayor's Pass) lasts for the stated number of days from purchase. Its daily credits must be claimed in the game each day; unclaimed days don't carry over.
• If we close the Service, Virtual Items end with it, without compensation except where the law requires.

5. Payments

• Payments are processed by Stripe. Prices are shown in U.S. dollars and may include or exclude taxes depending on where you live. We never see or store your full card number.
• By buying, you authorise the charge. Credits are added to your account once payment is confirmed.
• All sales are final. We do not offer refunds for in-game purchases, except where required by law. See the Refund Policy.
• If you file a chargeback or dispute for a purchase you made, we may suspend your account and remove the related Virtual Items.

6. Acceptable use

Follow our Rules. Do not cheat, use automation, exploit bugs, reverse engineer the Service beyond what the law allows, interfere with its operation, or use it to break the law.

7. Third-party services and content

The Service uses third-party services, including Google (sign-in), Stripe (payments), OpenStreetMap and its API providers (map data), and Wikidata and Wikipedia (city facts). Their own terms and policies apply to your use of them. Map data © OpenStreetMap contributors, available under the Open Database License. We are not responsible for third-party services or content.

8. Our content

The game, its code, graphics, name and logo belong to us or our licensors. We give you a limited, personal licence to play the game in your browser for fun. You may share screenshots and videos of your own gameplay.

9. Changes and availability

We may change, pause or stop any part of the Service at any time. We may update these Terms; the date at the top shows the latest version. If a change is significant, we'll try to let you know. If you keep using the Service after a change, you accept it.

10. Ending your account

You can stop playing at any time and ask us to delete your account. We may suspend or close accounts that break these Terms or the Rules. Sections 4, 5, 11, 12 and 13 survive after your account ends.

11. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, or that saved cities won't be lost. Historical and geographic content is simplified for a game and may be inaccurate.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 6 months before the claim, or US$50.

13. General

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except where your local consumer law gives you rights that cannot be waived. If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms; we may transfer them as part of a business transfer.
